od evening. i'm elizabeth cook. >> and i'm ken bastida. cbs 5 reporter kiet do on the plan to go after the does and leave the bucks alone. >> reporter: we've been talking to neighbors who say this is the time of night when they come out and eat people's rose bushes and leave deer droppings in the yard. this is a problem that's been exploding in the past year. here at the gated community known as the villages, the deer have figured out what seniors already knew. it's a great place to live. 24 hour security keeps predators out while the golf course offers a year round buffet. >> all that food and open terrain, it's deer paradise. >> reporter: the deer population has doubled every year. now about 170 does, bucks and fawns are roaming about. management wouldn't allow us to shoot video on the property but issued a statement saying the

deer have caused car accidents, injured dogs and damaged landscape. so starting this weekend workers will tank willies the does and spay them. females are targeted because they recover faster from the surgery. wildlife emergency services says it's a novel idea. >> i think it's creative. i think it's worth a try. unless that is kept in check and patrolled, i think that this will help, but i don't think it's a real long term solution. >> reporter: the other part of the plan? relocate entire deer families to the nearby hills. sean o'cal man says they'll just try to come right back. >> they going to tell the deer not to come back in? how are you going to keep them out? >> reporter: a lot of the people we talked to want the deer left alone.

consider what the management first hatched a couple years ago. they wanted a hire an archer and kill a lot of the deer with bows and arrows. >> wouldn't want that to happen. >> right now hundreds of people are lined up to talk about the man known as the super cop. the oakland city council supposed to vote on tiring bratton. he says officers must stop and frisk suspicious people. >> we know it's racial profiling. any young black or brown person who hits the quote unquote proguile is going to be subject to be harassed. >> reporter: why are you pegging that on bratton? >> because that's the mantra of bratton. that's what he's built his career on as a consultant.

and it's something that we're trying to move the department here in oakland away from. >> the council has to approve spending $250,000 to hire bratton. juliet says there are so many people waiting to speak the council may not vote tonight. >> there has been another school shooting. this time in texas. three people were shot at lone star college near houston. the witnesses say that two men were arguing in a courtyard outside the library, one person pulled a gun. shot the other. that sent everyone around them diving for cover. >> you couldn't hear what they were arguing about. we could hear them arguing. the shooter said, he said i don't want to fight you. i'm not trying to go to jail. he turned away from the situation. whatever ticked him off, whatever they said, turned around, got it out of his backpack and started shooting.

>> a maintenance man was also hit by gunfire. the target of the shooting is in critical condition. police say that the accused gunman accidentally also shot himself in the leg. >> we've heard a lot about catholic church sex abuse scandals, but nothing quite like this. cbs reporter bill wittacker. >> they ignored the children and left them to twist in the wind while they hunkiered down, covered up and protected themselves. >> reporter: raymond is a former alter boy, now the lead attorney representing some 500 victims of sex abuse by priests. the documents offer the strongest evidence yet of a cover up that reached to the top of los angeles clergy. now retired cardinal. >> that has always been paramount to the church for

decades. protect itself from scandal. >> reporter: many of the documents are correspondence between him and chief advisor. one is whether to allow a senior to return to his duties. he'd been sent away for treatment for sexually abusing as many as 17 youngsters. no one in the church high arky alerted authorities. i believe if he were to reappear he may have some type of legal action filed. he concurred. there are numerous, maybe 20 adolescents or young adults that he was involved with in a first degree felony manner. the cardinal issued this statement to the victims. i pray for them every single day. it ends simply, i'm sorry. victims held a press conference

>> it's not brand new. but there's more context, a little bit. some of them are offering prizes. >> reporter: example, coca- cola's ad. click on their site to watch it and decide who wins the race and how the commercial should end on super bowl day. so the viewer sees the commercial and coca-cola didn't pay a dime. you have a chance to be talked about in a way you don't if you're advertising somewhere else. mercedes wednesday leaked its ad today. encouraging the buzz. thousands of likes and dozens of comments about the suggestive commercial. >> missed a spot. >> reporter: the commercial that started all the buzz, that was the 1984 apple commercial. a one minute long vision

overnight. mercedes, jaguar, beamers. one of the cars was recovered nearby. the suspects ditched it when it ran out of gas. three of the four surveillance cameras were working and caught the suspects in the act. >> seeing about four or five kids. looked like young guys. shows them kicking the doors. shows them running on to my lot with random keys. checking which cars. >> the owner estimates the damage is at least $200,000. the thieves took off with all the keys so he can't move or sell the cars that he does have. >> a bay area director's feature film became the break out hit at the sundance film festival. the drama follows oscar grant on the day leading up to when he was shot and killed by a bart police officer. the film sparked a bidding war over the distribution rights.

it extends to social media. >> it may not be flattering for an employee to say gosh, there are unsafe working conditions here. i'm worried about the safety of myself and fellow coworkers. that's protected speech. >> reporter: here's what you can and can't do. it's okay to complain along with other employees for the purpose of improving salaries, benefits and working conditions. it's not okay to just vent by yourself. for example they upheld the firing of a bartender who was so upset of not getting a raise that he posted facebook comments. instead of saying don't post confidential information they need to be specific and say don't post trade secrets. some say they'd rather not criticize on or off line. >> i don't think it's appropriate.

>> reporter: the national labor board had forced giants to rewrite their social media policies but it gave high marks to walmart for making its policy more specific. >> yeah, you may not be able to get fired but i can't imagine that putting your thoughts on facebook even if it's not maybe super derogatory you're going to score points with the boss. i'd be worried about your reputation and relationship with your coworkers and boss. >> reporter: many of the people we talk to say it's not necessarily a great thing to do even though you may have a right to do it. you have to have common sense obviously. >> absolutely. sharon, thank you. colin kaepernick is making a mark on the nfl scene. >> so are his tattoos. most of the ink that's been making headlines was done by one tattoo artist. he lives in reno. he's been inking kaepernick

that will get here tomorrow. livermore, 14% of our january rainfall. that's it. san francisco right now, 3%. that's it. 3% of your average january rainfall. what a wet december and january mother nature turned the tap off. the clouds, you got that today. you'll have them out there tonight. all the moisture streaming up from the south will collide from the front. there's not that much moisture available. you'll get rain, but you're not going to have any problems. just scattered showers. primarily tomorrow afternoon. it's the leading edge of a pattern change that will have us looking to the north and west. gone is the dome of high pressure. that will keep us somewhat cooler. somewhat cloudier. a little reality check weatherwise. rainfall totals, very, very unimpressive. not looking at much at all around san francisco. here's what to expect.

showers will move in from the north to the south throughout the day tomorrow. till about sunrise on thursday. that thursday morning computer could be wet. more showers in the forecast this weekend. san jose tomorrow. right around 60 or 59 for pleasant hill. upper 50s for san francisco. thursday, friday, saturday we're dry. next rainmaker on sunday. we'll see clearing conditions but continued cool, highs in the 50s next monday and tuesday. next friday all the pep rallies at all the schools, everybody wearing niners gear. that's when it'll be fun. >> absolutely. >> coming up, we dig into the super bowl archives. the voodoo man of new orleans and how he protected joe montana.
